VSB Seeks Comment on Nondisclosure or Confidentiality Provisions or Agreements
The Virginia State Bar (VSB) seeks public comment on the use of nondisclosure or confidentiality provisions or agreements pursuant to or contained in settlement agreements reached in civil actions for personal injury arising from an unlawful act that would constitute criminal sexual assault, commercial sex trafficking, or other sexual offense that occurred during the infancy or incapacity of the injured person.
The Virginia General Assembly’s Senate Courts of Justice Committee has directed the VSB to study and make recommendations on this topic by November 1, 2026. The VSB Legal Ethics Committee requests comments on any aspect of the topic, to include policy or legal ethics considerations.
