DMAS Updates Procedures Concerning Lien Determinations, Updates, and Reduction Requests

Please note that the Department of Medical Assistance Services (DMAS) and the Office of the Attorney General (OAG) are reverting their policies and procedures respecting DMAS lien requests, for those requests made by email on or after April 1, 2024, back to the pre-pandemic format: DMAS will be the primary agency processing lien requests but, in those cases where you are seeking a reduction, DMAS will process and shuttle them to the OAG for negotiation. Again, this is a reversion to the pre-pandemic way of handling lien requests. This change should hopefully prove beneficial given: (1) HB315, which goes into effect January 1, 2025; (2) DMAS has invested in new IT systems which have either already gone online or will be going online in the coming months; and (3) with the last budget DMAS received funding for 17 more positions within their TPL unit.
